Breaking News! FLSA-Money Law debuts on the Real Housewives of Atlanta Show!

Word on the street is ATL Housewife Kandi Burruss-Tucker and her business enterprise(s) may be in hot water with the Fair Labor Standards Act (FLSA) wage law. One of her former employees, Johnnie Winston has filed a lawsuit alleging that during the time he was employed with Kandi’s firm, they failed to pay him in accordance with the law.

The FLSA (and various state/local wage payment laws) require employers to pay their employees at the minimum wage rate of $7.25 (in some states at a higher rate) per hour and overtime at the rate of 1.5 their regular hourly rate. Although the law provides for various exemptions from payment of OT, most employees are considered to be nonexempt and thus required to be paid OT.

Here is the kicker though, if it is determined by the court that Kandi/enterprises violated the law, then they will be liable for payment of back wages, employee’s attorney fees, court costs and possibly liquidated damages. So, as in most cases, the attorneys’ fees alone can end up being larger than the actual wage claims.

Big Ups to EEOC! Launches E-Inquiry and Intake Interview Appointment System for Potential Complainants!

Word on the street is that the EEOC has launched a pilot program that will allow potential complainants to electronically submit Initial Inquiries and Schedule Intake Interviews with the Agency. As you know, Initial Inquiries and Intake interviews are typically the first steps for individuals seeking to file discrimination charges with the EEOC. The EEOC receives about 200,000 inquiries per year resulting in approximately 90,000 of those inquiries becoming formal discrimination charges.

The E-pilot program was launched on March 13th in the following EEOC five offices, Charlotte, Chicago, New Orleans, Phoenix, and Seattle. Read more about the program.

Parent Company to Kay Jewelers and Jared the Galleria fighting off Sexual Harassment and Discrimination Allegations!

Word on the street is that Kay and Jared Jewelers’ reputation may be tarnished due to possible sexual harassment and discrimination allegations by more than 250 current/former employees. Their stock shares price dropped by approximately 13%, after the “stuff hit the fan”.

According to one former employee, routine sexual “preying” at company events “was done out in the open and appeared to be encouraged, or at least condoned, by the company during her employment. In addition, another former employee stated that “between 1994 and 2008 male executives prowled around like dogs that were let out of their cage and there was no one to protect the female managers from them.”

Uber Takes PREEMPTive Action to Thwart Susan Fowler Sexual Harassment Allegations! Hires former U.S. Attorney General Eric Holder to investigate alleged claims!

Recently a former Uber Engineer, Susan Fowler has claimed in a blog post that she was subjected to sexual harassment while employed at Uber. According to Ms. Fowler, “on my first official day rotating on the team, my new manager sent me a string of messages over company chat. He was in an open relationship, he said, and his girlfriend was having an easy time finding new partners but he wasn’t. He was trying to stay out of trouble at work, he said, but he couldn’t help getting in trouble, because he was looking for women to have sex with. It was clear that he was trying to get me to have sex with him, and it was so clearly out of line that I immediately took screenshots of these chat messages and reported him to HR.”

Women’s March on Washington 2017 – A Spectacular Moment Worldwide!

Our team member, Dorian was so grateful to have been part of Saturday’s extraordinary Women’s March on Washington that was a spectacular moment worldwide in which many people participated! Millions marched worldwide for human rights and freedom for all.  They marched in support of reproductive rights, for people with disabilities, for Black Lives Matter and Native Americans, etc.  Marchers held signs opposing misogyny, racism, homophobia, xenophobia, threats to immigrants, Muslims, and to the environment.  The overriding message was one of love and acceptance.

According to Dorian, the marchers’ faces showed determination, strength and hope and everyone was so kind.  The feeling of sisterhood and brotherhood was contagious and the March was so peaceful that Dr. King would have been proud.  Folks of all ages, including lots of men and families were marching.  There were young and old in wheelchairs, babies in strollers, children on their mom’s and dad’s shoulders, and tens of thousands of women, men and children in pink hats.

Many have stated that the Women’s March in DC was 2-3 times larger than the inauguration; that there were marches in every state; and that approximately 1 in 100 Americans took part in one of those marches.  Gloria Steinem, who was at the DC March said that she has never seen anything of this magnitude in her very long life.

Dorian felt that it was a sincere privilege to be part of this historic event and to be part of a movement that must endure.   On behalf of Dorian and the PREEMPT Team, We Stand United Together with the Women’s March and its supporters and will continue to Fight for Justice and “Empowerment through Equal Opportunity” for All!

Stand United with the Federal Government Workforce!

According to the Washington Post, the new administration is looking to remove or suspend Federal employees without notice or right to appeal, from service by the head of the agency at which such employee is employed for good cause, bad cause, or no cause at all. Commonly referred to as the “Employment at will” doctrine as many private sector employees in most states work. Read the full article here.

As an alumnae of the Federal Government, I am troubled by the continuous attack on the Federal workforce.  I can honestly state as a former federal employee that the Federal workforce is the hardest and most dedicated workforce and we are proud to stand united with them.  Whether you are a former/current Federal employee, Federal contractor or supporter, let your voice be heard by joining us in Standing United with the Federal Government Workforce.
