Janice Davis, serves as PREEMPT’s Legal Counsel and is a founding member of the law firm of Davis & Steele, founded in 1999. Prior to founding Davis & Steele, Janice practiced in the law firm of McKenna & Cuneo, L.L.P. (now Dentons – Washington, DC), where she was an associate from 1984-1993, and a partner from 1994-1999.
Specifically, Janice practices in the areas of government contracts counseling and litigation and labor and employment law counseling. In the area of government contracts, Janice has counseled clients on all aspects of pre-award and post-award government contract issues, including cost allowability and allocability, cost estimating and defective pricing, cost accounting standards, procurement integrity, protests, performance disputes, debarment and suspension, and contractor self-governance and compliance programs.
Janice’s government contracts practice also concentrates in the area of small and minority business counseling and litigation. She has counseled and represented small and minority firms on a variety of issues, including proposal preparation, teaming agreements, subcontracting, bid protests, claims preparation, the Small Business Administration regulations, and the Federal Acquisition Regulations. From 1997 to 1999, she served as General Counsel to the Maryland/District of Columbia Minority Supplier Development Council. She also served as counsel to the National Community Reinvestment Coalition (“NCRC”) Small Business Teaming Center from 2012 to 2015.
In addition, Janice has prepared training materials and lectured frequently on a variety of government contract and small business issues. She participated as a subcontractor, preparing training materials for the Office of the Under Secretary of Defense for Acquisition, Technology & Logistics (OUSD AT&L)/Small and Disadvantaged Business Utilization (SADBU) office entitled, “Benefit Analysis Guidebook to Facilitate Knowledge and Understanding of the Federal Contracting Requirements Regarding Contract Bundling and Consolidation.”
Janice has substantial experience defending companies, from small businesses to major aerospace companies, in their response to federal investigations, including Inspector General investigations, and in defense of allegations of civil and criminal fraud, including qui tam actions. Notably, she represented several companies in connection with the “Ill Wind” investigation of the mid-1980s. She also represented several individuals in the grand jury and congressional investigations concerning alleged transfers of technology to the People’s Republic of China.
Furthermore, Janice has lectured frequently on government contract issues and employment issues and has participated as a speaker in continuing legal education programs and government contract-related conferences. She served as a co-moderator in the Defense Supply Service – Washington Annual Small Business Conference and Exposition. She also served as a member of the faculty in the National Conference for Women Government Contract Professionals, sponsored by Business Development Associates. Also, Janice was a member of the faculty for the National Contract Management Association’s Annual Small Business Symposium and was also a lecturer at the Institute for Practical Federal Contracting’s seminar entitled “Maximizing Profits on Government Contracts.”
Finally, Janice received her B.S. in Economics and Administration & Management Science from Carnegie-Mellon University (with honors), and her Juris Doctor from the University of Michigan. She is licensed to practice in the District of Columbia, the United States Court of Federal Claims, and in several federal courts.
